Flint Bishop threatens Tesco over property website

Flint Bishop solicitors, acting on behalf of their client Hannells, have threatened legal action against Tesco.

Tesco Property Market Limited recently launched a website, which claims to answer all your home buying questions and enables users to view thousands of homes .

Hannells Ltd, one of the market leading estate agents within the Derbyshire area, discovered that copies of the photographs and parts of the details of its properties which they had placed on the Fish4 website had also appeared without Hannell’s consent on the Tesco website. Hannell’s lawyer, Qamer Ghafoor, a Partner at Flint Bishop Solicitors, intervened and threatened Tesco with an injunction and a claim for damages for infringement of copyright.

Qamer explained that once threatened with an injunction last week, Tesco did remove Hannells photos and details from its site. "We are in discussion with Tesco," he said. "I am investigating a claim for damages and for legal costs for my client. We also want assurance the photos and details will not appear on the Tesco site again."

Hannells, who have won two prestigious awards in two consecutive years of 2006 and 2007 as ‘estate agent and letting agency of the year’, with 11 outlets and over 1,000 property portfolio, advertises its properties for sale on the Fish4 website which displays photographs with written particulars of the property details. Alison Brain, Managing Director of Hannells maintained that it retained the copyright in these photographs and details.
