Court of Protection

Where a person loses capacity to make decisions for themselves and they do not have a Lasting Power of Attorney or Enduring Power of Attorney in place, an application can be made to the Court of Protection to appoint a deputy. The deputy is the person who can legally make decisions for the person who lacks capacity and can help them manage their finances and pay bills etc.

The role of the Court of Protection is to make decisions and appoint deputies to help those who lack capacity to
do so. This is the only way that you can legally make financial decisions for someone who no longer has capacity
to do so themselves and who has not made a Lasting Power of Attorney or Enduring Power of Attorney.

If a member of your family is starting to lose the ability to make decisions for themselves, we can advise you on
your options and assist you in making an application to the Court of Protection so that you can help them manage their affairs.
